TERMS AND CONDITIONS FOR SHORT-TERM RENTAL

1. Definitions

1.1. Lessor: The owner or manager of the property offered via the website.

1.2. Tenant: The person booking a property through the website.

1.3. Website: The platform where properties are listed and booked.

1.4. Agreement: The rental agreement established between the lessor and the tenant.

1.5. Rental Period: The agreed-upon duration of the stay in the rented property.

1.6. Security Deposit: An amount paid in advance by the tenant as a guarantee for potential damages or violations.

2. Applicability

2.1. These general terms and conditions apply to all bookings and agreements made through the website.

2.2. By making a booking, the tenant accepts these terms.

2.3. Deviations from these terms are only valid if agreed upon in writing.

3. Bookings and Payments

3.1. A booking is only final after confirmation by the lessor and receipt of the (down) payment.

3.2. Payments must be made in accordance with the payment terms stated on the website.

3.3. If payment is not made on time, the lessor has the right to cancel the booking without refunding any amounts already paid.

3.4. Any additional costs, such as cleaning fees or tourist taxes, will be communicated in advance and must be paid before or upon arrival.

4. Cancellations and Changes

4.1. Cancellations must be communicated in writing.

4.2. The following cancellation fees apply:

  • More than 30 days before arrival: 25% of the rental amount.
  • 15 to 30 days before arrival: 50% of the rental amount.
  • Less than 15 days before arrival: 100% of the rental amount.

4.3. Changes to the booking can only be made in consultation with the lessor and may incur additional costs. 4.4. If the tenant departs earlier than the agreed rental period, no refund will be provided.

5. Use of the Property

5.1. The tenant must use the property responsibly and prevent damage.

5.2. It is not allowed to accommodate more people than previously agreed.

5.3. Pets are only allowed if explicitly agreed upon.

5.4. Smoking is not permitted inside the property.

5.5. The tenant must comply with local laws and house rules.

5.6. Nuisance to neighbors must be avoided at all times.

5.7. The tenant is responsible for properly securing the property when absent and upon departure.

6. Liability and Security Deposit

6.1. The tenant is liable for any damage to the property or its contents during the rental period.

6.2. The lessor may require a security deposit, which will be refunded after the stay if no damage is found.

6.3. If damage or missing inventory is detected, the corresponding amount will be deducted from the security deposit. If the damage exceeds the deposit, the tenant must cover the remaining costs.

6.4. The lessor is not responsible for loss, theft, or damage to the tenant’s personal belongings.

6.5. Any damages must be reported to the lessor immediately.

7. Force Majeure

7.1. In the event of force majeure (such as natural disasters, pandemics, or other unforeseen circumstances), the lessor may cancel the booking. In such cases, a suitable solution such as rebooking or a refund will be sought.

7.2. The lessor is not liable for inconveniences caused by factors beyond their control, such as power outages, water disruptions, or construction work in the area.

8. Complaints and Disputes

8.1. Complaints must be reported to the lessor immediately so that a solution can be sought.

8.2. If a dispute cannot be resolved mutually, Portuguese law applies, and the court in the Algarve has jurisdiction.

8.3. The tenant is not entitled to a refund if a complaint is only reported after departure.

9. Privacy and Data Protection

9.1. Personal data of tenants will only be used for processing the booking and will be handled in accordance with applicable privacy laws.

9.2. The lessor may contact the tenant with relevant information regarding the booking and future offers, unless the tenant objects.

10. Final Provisions

10.1. If any provision of these general terms and conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force.

10.2. The lessor reserves the right to amend these terms. The terms in effect at the time of booking will continue to apply.
